Section 1 — Eligibility and Accounts

You must be legally capable of entering into a binding transaction to place an order. You agree to provide accurate, current and complete information when creating an account or placing an order and to update it when necessary.

You are responsible for keeping your account credentials secure and for activity carried out through your account, except where applicable law provides otherwise. Notify us promptly if you believe your account has been accessed without authorization.

Some account or checkout features may require email verification or a one-time password (OTP). You may be able to place an order as a guest where that option is available.

Section 2 — Products and Availability

We make reasonable efforts to display product descriptions, images, prices and specifications accurately. Product images are illustrative, and colours may look different depending on your screen and settings.

Product details, availability and prices may be updated from time to time. If an item is unavailable or a material error affects an order, we will contact you and explain the available options. CPA section 55 establishes standards for goods supplied to consumers, and section 56 provides an implied warranty of quality. Nothing in these Terms limits those or any other rights protected by South African consumer law.

Section 3 — Orders and Acceptance

Submitting an order is an offer to purchase the selected products. Orders are subject to product availability, successful payment where required and confirmation by SalesAkart.

Before you place an order, the checkout process should give you an opportunity to review the electronic transaction, correct errors and withdraw from the transaction before finally placing the order, as required by ECTA section 43(2). Contact us as soon as possible if you need to request a change or cancellation.

Section 4 — Prices, Taxes and Payment

Prices are displayed in South African Rand (ZAR). Prices displayed to consumers will include VAT where applicable, consistent with CPA section 23. Delivery fees and other charges applicable to the transaction will be disclosed before you complete checkout.

Payments may be processed through third-party providers, including PayFast. Available payment methods will be displayed at checkout. You must be authorized to use the payment method selected.

Section 5 — Shipping and Delivery

Delivery is available across South Africa, subject to courier coverage and product availability. Processing, delivery estimates, shipping charges, tracking, store pickup and delay handling are described in our Shipping Policy.

Delivery estimates are not guarantees unless expressly stated otherwise. Under ECTA section 46, an online order must be executed within 30 days unless another period has been agreed.

Section 6 — Returns, Refunds and Warranties

Returns, refunds, exchanges, replacements and warranty matters are governed by our Return and Refund Policy, product-specific warranty information and applicable South African law.

Relevant statutory rights include CPA section 20 (certain returns), CPA sections 55-56 (quality standards and implied warranty), CPA section 16 (cooling-off following certain direct-marketing transactions), and ECTA section 44 (cooling-off for qualifying electronic transactions). Nothing in these Terms limits a right that the CPA, ECTA or another applicable South African law does not permit us to exclude.

Section 7 — Intellectual Property

Unless otherwise stated, website content, branding, logos, text, graphics, design elements and other materials are owned by SalesAkart or used under license. Third-party names, trademarks and logos belong to their respective owners.

You may access the website for personal and lawful shopping purposes. You may not reproduce, distribute, modify, republish or commercially exploit website content without prior written permission, except where permitted by law.

Section 8 — Third-Party Services and Links

Our Services may include links to third-party websites, payment services, courier services or other tools. We do not control all third-party services and are not responsible for their independent content, policies or availability. Your use of those services may be subject to separate terms.

Section 9 — Privacy

Our collection and use of personal information is described in our Privacy Policy and is subject to POPIA. Relevant provisions include section 11 (lawful processing), section 18 (notice when collecting information), sections 19-22 (security safeguards and compromises), sections 23-24 (access and correction/deletion), section 69 (electronic direct marketing) and section 72 (cross-border transfers).

Section 10 — Reviews and Feedback

If you submit a review, suggestion or other feedback, you confirm that it is truthful to the best of your knowledge, relates to the subject matter and does not unlawfully infringe another person's rights.

You grant SalesAkart permission to use the feedback to operate, improve and promote the Services, subject to applicable law and any rights you retain. We may moderate or remove content where reasonably necessary.

Section 11 — Prohibited Conduct

You must not:

  • Use the Services for unlawful, fraudulent or deceptive purposes.
  • Attempt unauthorized access to accounts, systems or data.
  • Interfere with the security, operation or availability of the website.
  • Upload malware or other harmful code.
  • Misuse another person's personal information.
  • Infringe intellectual-property or other legal rights.
  • Submit false, abusive, defamatory or misleading content.
  • Use automated tools to interfere with the website or collect data in a manner that violates applicable law or our published rules.

Section 12 — Disclaimer and Service Availability

We aim to keep the website accurate and available, but we do not guarantee that access will always be uninterrupted or error-free. Maintenance, technical issues and events outside our reasonable control may affect availability.

Any disclaimer or limitation in these Terms must be read consistently with the CPA. In particular, terms must not be unfair, unreasonable or unjust contrary to CPA section 48, and prohibited terms under section 51 are not incorporated into these Terms.

Section 13 — Limitation of Liability

Any limitation of liability will apply only to the extent it is lawful, fair and enforceable under South African law, including the CPA. It will not exclude or restrict rights or remedies that may not lawfully be excluded, including consumer rights under CPA sections 55-56.

Section 14 — Indemnity

Where permitted by law, you are responsible for losses directly caused by your unlawful misuse of the Services or material breach of these Terms. Nothing in this clause requires you to indemnify SalesAkart for its own unlawful conduct or for liability that cannot legally be transferred to you.

Section 15 — Suspension or Termination

We may restrict or suspend access where reasonably necessary to protect customers, the website or our business, investigate suspected fraud, comply with law or address a material breach of these Terms. We will act consistently with applicable law and any rights relating to an existing order.

Section 16 — Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices or legal requirements. The current version will be posted on this page with an updated date. Changes apply prospectively unless otherwise stated and permitted by law.

Section 17 — Governing Law

These Terms are governed by the laws of the Republic of South Africa, including applicable provisions of the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and, for personal information, the Protection of Personal Information Act 4 of 2013. Nothing in this clause limits any mandatory rights or remedies available to a consumer under South African law.
